TERMS OF SERVICE
Last updated: September 2026
OVERVIEW
Welcome to Jacquelines Arts.
These Terms of Service apply to your use of the Jacquelines Arts website and your purchase of products from our online store.
Throughout these Terms, "we", "us", "our" and "Jacquelines Arts" refer to Jacquelines Arts. "You" and "your" refer to the person using our website or purchasing our products.
By accessing or using our website, or placing an order with us, you agree to these Terms of Service and our Privacy Policy.
Please read these Terms carefully before using our website or placing an order. If you do not agree with these Terms, please do not use our website or purchase our products.
These Terms are subject to your rights under applicable New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these Terms is intended to limit or exclude any rights or remedies that cannot legally be limited or excluded.
OUR STORE
Our store is operated by Jacquelines Arts and is hosted by Shopify.
Products available through our store may include art prints, stationery, stickers, bookmarks, mail club subscriptions and other creative products.
We reserve the right to update, change, discontinue or limit products at any time. Any changes will not affect an order that has already been accepted unless required by law.
PRODUCT INFORMATION
We do our best to ensure that product descriptions, photographs, colours, sizes and other information on our website are accurate.
Colours may appear slightly different depending on your device, screen settings and lighting.
Because many of our products are printed or produced from original artwork, there may be minor variations between individual products. These variations are not necessarily defects.
We will provide products that match their description and meet the guarantees required by New Zealand law.
ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
Once your order has been received and payment has been successfully processed, we will generally accept and process your order.
We reserve the right to decline or cancel an order where there is a genuine reason to do so, such as an obvious pricing or product description error, suspected fraudulent activity, or an issue with product availability. If we cancel an order after payment has been taken, we will arrange a refund of the amount paid for that order.
Please check your order carefully before completing your purchase, including your delivery address and selected products.
PRICES AND PAYMENT
All prices displayed on our website are in New Zealand dollars (NZD), unless otherwise stated.
Prices may change from time to time, but changes will not affect an order that has already been accepted.
The price you pay will be the price displayed at the time you place your order, together with any applicable delivery charges.
Payment is processed securely through the payment methods made available at checkout.
You agree to provide accurate and complete billing and contact information when placing an order.
SUBSCRIPTIONS
Some products, including The Wildwood Post Mail Club, may be offered as a recurring subscription.
When you purchase a subscription, you agree to recurring charges at the price and frequency displayed at checkout.
The Wildwood Post Mail Club is currently offered as a monthly subscription. Your subscription will automatically renew each month until you cancel it.
You can cancel your subscription at any time through your customer account or by contacting us.
Cancelling a subscription will stop future subscription charges and deliveries. If a payment has already been processed before you cancel, that order will generally still be fulfilled, subject to your rights under applicable New Zealand law and our Return and Refund Policy.
Where available, subscription management options may also allow you to pause or skip a future delivery.
Subscription prices may change in the future. Where a change affects an existing subscription, we will provide any notice required by law and/or by the applicable subscription service.
Further information about cancelling subscriptions is provided in our Purchase Options Cancellation Policy.
DELIVERY AND SHIPPING
We aim to dispatch orders within the timeframe stated on our website or otherwise communicated to you.
Delivery times are estimates and may vary depending on the destination, postal service, customs processing and circumstances outside our reasonable control.
For New Zealand orders, delivery timeframes may vary depending on the postal service and destination.
For international orders, delivery times may be longer and may be affected by customs processing or other requirements in the destination country.
Any delivery charges will be shown at checkout before you complete your purchase.
You are responsible for providing a correct and complete delivery address. If an order is returned to us because an incorrect or incomplete address was provided, please contact us so we can discuss the available options.
If your order does not arrive, arrives damaged, or there is another issue with delivery, please contact us at hello@jacquelinesarts.com so we can investigate and assist you.
Nothing in this section limits your rights under New Zealand consumer law.
RETURNS, REFUNDS AND FAULTY PRODUCTS
Our Return and Refund Policy explains our approach to returns, refunds and exchanges.
If a product is faulty, damaged, does not match its description, or otherwise fails to meet a guarantee required by the Consumer Guarantees Act 1993, you may have rights to a repair, replacement or refund depending on the circumstances.
Nothing in our Return and Refund Policy or these Terms is intended to remove or restrict those legal rights.
If you have a problem with an order, please contact us at hello@jacquelinesarts.com with your order number and details of the issue. Where appropriate, we may ask for photographs or other information so that we can assess the issue.
Change-of-mind returns are handled in accordance with our Return and Refund Policy and any rights that apply under New Zealand law.
INTELLECTUAL PROPERTY
Unless otherwise stated, the artwork, illustrations, photographs, designs, text, branding, logos and other content appearing on the Jacquelines Arts website and in our products are owned by or licensed to Jacquelines Arts.
You may use our website and purchased products for your personal, non-commercial use.
You must not reproduce, copy, distribute, modify, sell, commercially exploit or otherwise use our artwork, illustrations, designs, photographs, branding or other content without our prior written permission.
Purchasing a physical product does not transfer ownership of the underlying artwork or intellectual property to you.
If you purchase a print or other artwork product, the intellectual property rights in the original artwork remain with Jacquelines Arts unless we have expressly agreed otherwise in writing.
CUSTOM AND PERSONAL INFORMATION
If you provide us with photographs, personal information, names or other material for the purpose of creating or fulfilling an order, you confirm that you have the necessary rights or permission to provide that material to us.
We will use information provided to us for the purposes of processing and fulfilling your order, communicating with you and providing our services, in accordance with our Privacy Policy.

ERRORS AND CHANGES
We make reasonable efforts to ensure that information on our website is accurate and up to date.
However, there may occasionally be typographical errors, incorrect information or other mistakes relating to products, prices, promotions, availability or delivery information.
If we identify a significant error before an order has been accepted, we may correct the error and, where appropriate, contact you before processing the order.
We may also update or change website content, products, prices and services from time to time.
LIMITATION OF LIABILITY
To the extent permitted by law, Jacquelines Arts will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded or limited under New Zealand law.
Nothing in these Terms limits our obligations under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or any other applicable New Zealand legislation.
EVENTS OUTSIDE OUR CONTROL
We will not be responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, extreme weather, postal or courier disruptions, strikes, government restrictions, technical failures or other events beyond our reasonable control.
Where an event outside our reasonable control affects your order, we will take reasonable steps to communicate with you and assist where possible.
CHANGES TO THESE TERMS
We may update these Terms of Service from time to time.
The most current version will be available on our website.
Changes will apply from the date they are published unless otherwise stated.
If a change is required to comply with the law or materially affects an existing subscription or order, we will provide any notice required by applicable law.
GOVERNING LAW
These Terms of Service are governed by the laws of New Zealand.
Any dispute arising in relation to these Terms or a purchase from Jacquelines Arts will be dealt with in accordance with the laws of New Zealand and the applicable courts and dispute resolution processes of New Zealand.
